The Virginia Court of Appeals has upheld the dismissal of murder convictions against Ronald Taft Davis III for a 2008 fatal shooting in Surry.

A panel of Virginia’s Court of Appeals reversed the judgment of the trial court.

It dismissed the felony first degree and attempted murder indictments against Davis on the basis of “collateral estoppel,” or double jeopardy, on Feb. 25.

At the request of the Attorney General’s Office, the appeals court reheard the case “en banc,” or by the full, 11-judge court.

On Oct. 21, the full court decided to uphold the appeal.
