TERMS OF SALE:  The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale.  A deposit of $20,000.00, or 10% of the sale price, whichever is lower, in cash or cashier’s check payable to the SUBSTITUTE TRUSTEE will be required at the time of sale.  The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale.  In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee.  All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. In the event taxes, any other public charges have been advanced, a credit will be due to the seller, to be adjusted from the date of sale at the time of settlement.  Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $445.00 for review of the settlement documents.

Notice is hereby given that the Isle of Wight County Board of Supervisors will hold a Public Hearing on Thursday, July 16, 2015 to consider the following: 

 

The application of Raymond J. Barlow, owner, for a Conditional Use Permit on 3.68 acres of land, located at 17541 Scott’s Factory Road in the Windsor Election District.  The purpose of the application is to allow for custom manufacturing on the site.

 

The application of Eagle Harbor LLC, owner, and Jennifer Howard Szakaly, applicant, for a Conditional Use Permit (CUP) to allow for a car wash on 1.093 acres of land, Parcel 9C-2 of Eagle Harbor Subdivision, on Eagle Harbor Parkway in the Newport Election District.

 

A resolution to amend the Comprehensive Plan of Isle of Wight County, Virginia through changes to land use, including transportation, utilities and other public facilities in the Newport Development Service District and adjacent areas as commonly referred to as the ISLE 2040 Plan.  The purpose for these changes is to respond to County and market conditions which have evolved significantly since the adoption of the Comprehensive Plan.

 

An ordinance to amend and reenact the following sections of the Isle of Wight County Code, Appendix B, Zoning: Article IV, Zoning Districts and Boundaries; Article V, Supplementary Use Regulations; Article X, Vehicle Parking Facilities; in order to make revisions based on the County’s ISLE 2040 Plan.

 

Copies of said applications are on file in the Department of Planning and Zoning at the Isle of Wight County Courthouse Complex, Isle of Wight, Virginia, and is available for public examination.

 

Any person desiring to be heard in favor of, in opposition to, or to express his or her views with respect to said applications may appear before and be heard by said Board of Supervisors during the Public Hearing to be held in the Robert C. Claud, Sr. Board Room at the Isle of Wight County Courthouse Complex on Thursday, July 16, 2015. The public meeting is scheduled to start at 6:00 p.m.

THE TOWN OF SMITHFIELD BOARD OF ZONING APPEALS

SPECIAL YARD EXCEPTION

 

            Notice is hereby given that the Board of Zoning Appeals of the Town of Smithfield, Virginia, will hold a public hearing at the regular meeting of the Board of Zoning Appeals in the council chambers in The Smithfield Center, 220 N. Church Street, Smithfield, Virginia, in meeting room A, on Tuesday, July 21, 2015, at 7:30 p.m. to consider the application of Janet Buppert, owner, for a special yard exception under the provisions of Article 12, Section D of the Zoning Ordinance of the Town of Smithfield, Virginia, adopted September 1, 1998, and as amended thereafter, in order to approve an existing residential structure with a front yard setback 34 feet.  The applicant proposes to construct a room addition to the rear of the dwelling house which will meet the current ordinance requirements.  The Special Yard Exception will cure the violation. The property is located at 1202 Wilson Road.  The minimum front yard setback is 35 feet, as provided by the Zoning Ordinance. The subject property is zoned N-R Neighborhood Residential District.

Notice is hereby given pursuant to Section 15.2-2204 of the Code of Virginia, 1950 as amended that the Planning Commission of the Town of Windsor will hold public hearings on Wednesday July 22, 2015 at 7:00 p.m. in the Town Hall Council Chamber on the matters described as follows:

 

LAND DEVELOPMENT ORDINANCE-  Proposed draft of a new Land Development Ordinance that among other changes renames several districts, creates a new Planned Unit Development District, creates a new site-plan review process for certain types of activities and redefines, clarifies and amends numerous text items from the previous Land Development Ordinance.  The proposed Ordinance deals with all aspects of land development within the Town of Windsor including all types of Zoning and Subdivision matters.
