Public Notice – Environmental Permit




Purpose of notice: To seek public comment on a draft permit from the Department of Environmental Quality that will allow the release of treated domestic wastewater from a regulated municipal activity into a water body in Isle of Wight County, Virginia.

Project description: The Hampton Roads Sanitation District (HRSD) has applied for the reissuance of a permit for treated domestic waste water from their municipal wastewater treatment plant that serves a residential development consisting of 155 homes in Smithfield, Virginia. The proposed design flow of the facility will be .05 MGD. The permit will allow the applicant to discharge treated, disinfected municipal wastewater to Lawnes Creek in Smithfield, Isle of Wight Co. to the Lower James River Basin watershed. A watershed is the land area drained by a river and its incoming streams. The permit will limit the following pollutants to amounts that protect water quality: pH, biochemical oxygen demand, total suspended solids, total kjeldahl nitrogen, total nitrogen and total phosphorus annual loadings, dissolved oxygen, enterococci, fecal coliform and total residual chlorine. Sludge from the treatment process will be transported to an HRSD facility for additional treatment prior to disposal.


HOW TO COMMENT AND/OR REQUEST A PUBLIC HEARING: DEQ accepts comments and requests for public hearing by hand-delivery, by e-mail, by fax or postal mail. All comments and requests must be in writing and be received by DEQ during the comment period. Submittals must include the names, mailing addresses and telephone numbers of the commenter/requester and of all persons represented by the commenter/requester. A request for public hearing must also include: 1) The reason why a public hearing is requested. 2) A brief, informal statement regarding the nature and extent of the interest of the requester or of those represented by the requestor, including how and to what extent such interest would be directly and adversely affected by the permit. 3) Specific references, where possible, to terms and conditions of the permit with suggested revisions. A public hearing may be held, including another comment period, if public response is significant, based on individual requests for a public hearing, and there are substantial, disputed issues relevant to the permit.

Notice is hereby given that the Isle of Wight County Board of Supervisors will hold a Public Hearing on Thursday, October 20, 2016 to consider the following:




The application of Mark Stevenson, applicant, on behalf of Hope Presbyterian Church, owners, for a change in zoning classification from Rural Agricultural Conservation (RAC) to Conditional Rural Residential (C-RR) of approximately 11.34 acres of land located on the west side of Great Spring Road, between Fox Ridge Lane and Stallings Lane, Smithfield, in the Hardy Election District. The purpose of the application is to rezone the property for residential use.




An ordinance to amend and reenact the following sections of the Isle of Wight County Code, Appendix B, Zoning: Article I, General Provisions; Section 1020, Nonconforming Situations; in order to make updates enacted by the state legislature.




An ordinance to amend and reenact the Isle of Wight County Code by amending and reenacting Appendix A. Subdivisions. Article 3. Administration and Procedures. Section 3.2. Review and Approval and Appendix B. Zoning. Article I. General Provisions. Section 1-1016. Conditional Zoning.  The purpose of these amendments are to ensure proper compliance with newly enacted legislation limiting the review and approval of proffers by localities.




Copies of said application and ordinance amendments are on file in the Department of Planning and Zoning at the Isle of Wight County Courthouse Complex, Isle of Wight, Virginia, and are available for public examination.




Any person desiring to be heard in favor of, in opposition to, or to express his or her views with respect to said application and ordinance amendments may appear before and be heard by said Board of Supervisors during the Public Hearing to be held in the Robert C. Claud, Sr. Board Room at the Isle of Wight County Courthouse Complex on Thursday, October 20, 2016. The public meeting is scheduled to start at 6:00 p.m.
