The object of the above styled suit is to declare that certain Right of First Refusal recorded in the Clerk’s Office of the Isle of Wight Circuit Court at Deed Book 271, page 133, null, void and of no effect as it pertains to that certain lot, piece or parcel of land together with all rights of way, privileges and easements and riparian rights attached thereto are in anywise appertaining thereto, situate, lying and being in Newport Magisterial District, Isle of Wight County, Virginia, known, numbered and designated as Lot 32, Section 4, of the subdivision known as James River Heights, as shown on a certain plat of survey styled, “PLAT SHOWING THE LOCATION OF SECTION 1, 2, 3 AND 4, JAMES RIVER HEIGHTS, “ made in December, 1954, a plat of said survey being duly of record in the Clerk’s Office of the Circuit Court of Isle of Wight County, Virginia, in Plat Book 3, at Page 256, Reference being hereby specifically made to said plat of survey for a more particular description of said lots.
AND IT APPEARING by Affidavit filed according to law that the above named Defendants cannot be found and that diligence has been used without effect to ascertain the location of the parties to be served or as set out in the pleadings they are a person or persons, as Defendants by the general description of “Parties Unknown” it is therefore ordered that the unknown heirs, assigns, devisees or grantees of JAMES RIVER PARTNERS, a VIRGINIA GENERAL PARTNERSHIP, HAROLD C. BEAVER, CAROLE B. GROLLA, and VICTORIA S. BEAVER, if any there may be, and all other persons who may be interested in the subject matter of this suit whose names and whereabouts are unknown, all of whom are made parties hereto under the general description of “PARTIES UNKNOWN”, whether of record or not, appear on or before the 14th day of December, 2018 in the Clerk’s Office of this Court and do what is necessary to protect their interest.
AND IT IS FURTHER ORDERED that this Order be published once a week for four successive weeks in the Smithfield Times, a newspaper of general circulation in the County of Isle of Wight; that a copy of this Order be posted at the front door of the courthouse wherein this court is held; and that a copy of this Order be mailed to the Defendants at the addresses shown by the aforesaid Affidavit, if any.

The Plaintiff filed this suit pursuant to Va. Code § 58.1-3965, et seq., to enforce its delinquent tax liens against the following real estate standing in the name of Charlie R. Wilkins, Jr. and Delia Wilkins:

An affidavit having been filed that the Plaintiff used due diligence to locate the unknown heirs, devisees and successors in interest of Arthur C. Longerbeam, but without effect; that the post office addresses of the unknown heirs, devisees and successors in interest of Arthur C. Longerbeam are unknown; that the Plaintiff served Defendants Charlie R. Wilkins, Jr. and Delia Wilkins, if living, by posted service at their last known post office address of 3405 Scott Street, Portsmouth, VA 23707 and has used due diligence to ascertain any other location for them, but without effect; that if Charlie R. Wilkins, Jr. and Delia Wilkins are not living, the Plaintiff used due diligence to locate their unknown heirs, devisees and successors in interest, but without effect; that the post office addresses of the unknown heirs, devisees and successors in interest of Charlie R. Wilkins, Jr. and Delia Wilkins are unknown; and that there may be other persons having an interest in the property whose names and addresses are unknown, and those claiming through the aforementioned parties, all such persons made defendants as “Parties Unknown.”
It is ORDERED that this Order be published at least once a week for two successive weeks in the Smithfield Times, a newspaper of general circulation in Isle of Wight, Virginia, and that the parties named herein appear at 9 a.m. November 21, 2018, in the Isle of Wight Circuit Court Clerk’s Office and do what may be necessary to protect their respective interests.
