ORDER OF PUBLICATION

The object of the above styled suit is to declare that certain Right of First Refusal recorded in the Clerk’s Office of the Isle of Wight Circuit Court at Deed Book 271, page 133, null, void and of no effect as it pertains to that certain lot, piece or parcel of land together with all rights of way, privileges and easements and riparian rights attached thereto are in anywise appertaining thereto, situate, lying and being in Newport Magisterial District, Isle of Wight County, Virginia, known, numbered and designated as Lot 32, Section 4, of the subdivision known as James River Heights, as shown on a certain plat of survey styled, “PLAT SHOWING THE LOCATION OF SECTION 1, 2, 3 AND 4, JAMES RIVER HEIGHTS, “ made in December, 1954, a plat of said survey being duly of record in the Clerk’s Office of the Circuit Court of Isle of Wight County, Virginia, in Plat Book 3, at Page 256, Reference being hereby specifically made to said plat of survey for a more particular description of said lots.
AND IT APPEARING by Affidavit filed according to law that the above named Defendants cannot be found and that diligence has been used without effect to ascertain the location of the parties to be served or as set out in the pleadings they are a person or persons, as Defendants by the general description of “Parties Unknown” it is therefore ordered that the unknown heirs, assigns, devisees or grantees of JAMES RIVER PARTNERS, a VIRGINIA GENERAL PARTNERSHIP, HAROLD C. BEAVER, CAROLE B. GROLLA, and VICTORIA S. BEAVER, if any there may be, and all other persons who may be interested in the subject matter of this suit whose names and whereabouts are unknown, all of whom are made parties hereto under the general description of “PARTIES UNKNOWN”, whether of record or not, appear on or before the 14th day of December, 2018 in the Clerk’s Office of this Court and do what is necessary to protect their interest.
AND IT IS FURTHER ORDERED that this Order be published once a week for four successive weeks in the Smithfield Times, a newspaper of general circulation in the County of Isle of Wight; that a copy of this Order be posted at the front door of the courthouse wherein this court is held; and that a copy of this Order be mailed to the Defendants at the addresses shown by the aforesaid Affidavit, if any.

Notice is hereby given that the Isle of Wight County Board of Supervisors will hold a Public Hearing on Thursday, November 15, 2018 to consider the following applications:

The application of Jeremy H. and Lucy M. Kooiman, owners, for an exception to the Chesapeake Bay Preservation Area Ordinance under Article 4, Section 4001 to place a 16×16 foot garden shed in the Resource Protection Area (RPA) buffer and to allow for a mitigation landscaping reduction at 214 Shivers Mill Lane, Carrollton with tax map parcel 43A-06-025.

An ordinance to amend and reenact the following sections of the Isle of Wight County Code, Appendix B, Zoning: Article III, Use Types, Article IV, Zoning Districts and Boundaries, and Article V, Supplementary Use Regulations, for the purpose of including Family Burial Plots as a permitted use in the Rural Agricultural Conservation Zoning District and to permit the use of Shipping Containers as accessory storage structures in residential and commercial zoning districts.

Copies of said applications are on file in the Department of Planning and Zoning at the Isle of Wight County Courthouse Complex, Isle of Wight, Virginia, and are available for public examination.

Any person desiring to be heard in favor of, in opposition to, or to express his or her views with respect to said applications may appear before and be heard by said Board of Supervisors during the Public Hearing to be held in the Robert C. Claud, Sr. Board Room at the Isle of Wight County Courthouse Complex on Thursday, November 15, 2018. The public meeting is scheduled to start at 6:00 p.m.

The County of Isle of Wight is in compliance with the Americans with Disabilities Act of 1990.
