SPECIAL COMMISSIONER’S SALE OF VALUABLE REAL ESTATE

Pursuant to the decree of the Isle of Wight County Circuit Court, entered in the chancery cause of County of Isle of Wight, Virginia v. Rufus Darden, III, if living, and if not, then the unknown heirs, devisees and successors in interest of Rufus Darden, III, et al. Case No. CL18-613; James J. Reid, Special Commissioner, will offer for sale the following real estate at public auction to the highest bidder on Thursday, March 28, 2019 at 10:00 AM at the Hilton Garden Inn, 100 East Constance Road, Suffolk, VA 23434.

The terms of the sale shall be cash, or in the alternative, a down payment of not less than 20% of the successful bid price at the time of sale, by cash or certified check payable to Isle of Wight Circuit Court Clerk, at the time of sale for bids over $3,000.00, to be deposited by the Special Commissioner with the balance due in ten (10) days, also by cash or certified check to the Special Commissioner at the office of David, Kamp & Frank, LLC, 739 Thimble Shoals Blvd., Ste. 105, Newport News, VA 23606. High Bids of $3,000.00 or less, will require full payment at the Auction. All real estate shall be sold, “As Is,” in gross and not by the acre, and subject to, without limitations, restrictions, conditions, easements, liens or encumbrances of record, possible rights of parties in possession, encroachments, overlaps, gaps and gores, deficiencies in quantity, all question of boundaries, location and acreage which a current and accurate survey would disclose, roadways, environmental and wetland matters, unrecorded easements, matters which would be disclosed by an inspection of the premises, or any other matter of record or not of record. Real estate sold through the judicial sale process will be sold free of all claims of any creditor, person or entity pursuant to Virginia Code §58.1-3967. et seg. Before the Special Commissioner delivers a special warranty deed to the successful bidder, they shall report the result of the sale to the Court for Confirmation. The sale shall be subject to confirmation by the Court.

ORDER OF PUBLICATION

The Plaintiff filed this suit pursuant to Va. Code § 58.1-3965, et seq., to enforce its delinquent tax liens against the following real estate standing in the name of French Jack Hicks, III: Tax Map No.: 06I-01-001 Brief Description: L1 Allendale Estates

An affidavit having been filed that the Plaintiff used due diligence to locate the unknown heirs, devisees and successors in interest of P.D. Wells, but without effect; that the post office addresses of the unknown heirs, devisees and successors in interest of P.D. Wells are unknown; that the Plaintiff used due diligence to locate Defendant French Jack Hicks, III, if living, at his last known post office address of 837 Sharpley Avenue, Hampton, VA 23666 and has used due diligence to ascertain any other location for him, but without effect; that if French Jack Hicks, III is not living, the Plaintiff used due diligence to locate his unknown heirs, devisees and successors in interest, but without effect; that the post office addresses of the unknown heirs, devisees and successors in interest of French Jack Hicks, III are unknown; and that there may be other persons having an interest in the property whose names and addresses are unknown, and those claiming through the aforementioned parties, all such persons made defendants as “Parties Unknown.”
It is ORDERED that this Order be published at least once a week for two successive weeks in the Smithfield Times, a newspaper of general circulation in Isle of Wight, Virginia, and that the parties named herein appear at 9 a.m. March 27, 2019, in the Isle of Wight Circuit Court Clerk’s Office and do what may be necessary to protect their respective interests.
