improved real property, with an abbreviated legal description of All that certain lot, piece or parcel of land, situate, lying and being in Hardy District, Isle of Wight County, Virginia, known, numbered and designated as Lot Number 9 on the Plat of “Cecil W. Gwaltney Property”, made on March 18, 1970, by Road Brinkley, C.L.S. Number 684, which plat is of record in the Clerk’s Office of the Circuit Court of Isle of Wight County, in Deed Book 201, page 654, and which lot is further described as follows: Beginning at an iron pin on the South side of Virginia Route No. 682, which iron pin is at Northwest corner of Lot Number 8, thence from said point of beginning South 2 degrees 30’ West 200 to a point, a corner; thence South 89 degrees 30’ West 100 feet to a point, a corner on the property of Cecil W. TERMS OF SALE: The property will be sold “AS IS,” WITHOUT REPRESENTATION OR WARRANTY OF ANY KIND AND SUBJECT TO conditions, restrictions, reservations, easements, rights of way, and all other matters of record taking priority over the Deed of Trust to be announced at the time of sale. A deposit of $20,000.00, or 10% of the sale price, whichever is lower, will be required at time of sale, in the form of certified check, cashier’s check or money order by the purchaser. The balance of the purchase price, with interest at the rate contained in the Deed of Trust Note from the date of sale to the date said funds are received in the office of the SUBSTITUTE TRUSTEE, will be due within fifteen (15) days of sale. In the event of default by the successful bidder, the entire deposit shall be forfeited and applied to the costs and expenses of sale and Substitute Trustee’s fee. All other public charges or assessments, including water/sewer charges, whether incurred prior to or after the sale, and all other costs incident to settlement to be paid by the purchaser. Purchaser agrees to pay the seller’s attorneys at settlement, a fee of $460.00 for review of the settlement documents.

Town of Windsor – Town Council

PUBLIC HEARING

The Town Council of the Town of Windsor will hold a public hearing on Tuesday, November 12, 2019, in the Windsor Town Hall located at 8 E Windsor Blvd., Windsor, Virginia, to consider the following:

Beginning at 7:00 p.m.

To rezone a portion of parcel 54-01-067 from General Agricultural A-1 to Residential District R-1. The property is located on Buckhorn Drive in the Town of Windsor, VA. The purpose of the rezoning is to allow for the subdivision of said property, with the creation of two new parcels that would be zoned R-1. The comprehensive plan identifies this location to be agricultural, with a current density of 0.014 units per acre. The two new parcels will have a housing density of 0.344 acre per unit, and 0.466 unit per acre.

Any persons desiring to be heard in favor of or in opposition to the above is hereby invited to be present at the Public Hearing. NOTICE OF TRUSTEE’S SALE OF IMPROVED REAL ESTATE
 17253 RIDDICK ROAD, SMITHFIELD, VIRGINIA

In execution of a Deed of Trust signed by Michael C. Newsome, dated April 24, 2013, recorded in the Clerk’s Office of the Circuit Court of the County of Isle of Wight, Virginia on May 9, 2013 as Instrument No. 130002526, the said Trustee will offer for sale at public auction at the front door of the Young-Laine Courts Building at 17000 Josiah Parker Circle, Isle of Wight, Virginia on the7th day of November, 2019 at 12:00 p.m., the improved real estate lying in the County of Isle of Wight, Virginia and more particularly described as follows:

All that certain lot, piece or parcel of land in Newport Magisterial District of Isle of Wight County, Virginia, which was conveyed to Clinton B. Newsome and Betty J. Newsome, husband and wife, as tenants by the entirety with right of survivorship, by Trustee’s Deed dated May 13, 1999, duly recorded in the Clerk’s Office of the Circuit Court of Isle of Wight County, Virginia, on May 17, 1999, as Instrument #990002659, wherein the property was described as follows:

Riley, a corner; thence in a general northwesterly direction 165 feet through an open well to the point of beginning.”

“Also, all right, title and interest in and to a certain well located on the property line between the property of the Carroll B. Riley estate, and the property of Dennis E. Keen and Tammie C. Keen, as shown on a plat of survey entitled ‘Plat of the Property of Dennis E. Keen and Tammie C. Keen, Formerly the Property of L. R. Wright and J. O. Timberlake, Deed Book 314, Page 106 Located in Newport Magisterial District, Isle of Wight County, Virginia’, as recorded in the aforesaid Clerk’s Office in Deed Book 323, at page 432, with an exclusive perpetual right of way thirty (30) feet wide from the above described lot to the said County Road 604 along the northern boundaries of the property now or formerly of Carroll B. Riley and the property described above.”

The sale is subject to conditions, covenants, restrictions, reservations, easements, rights of way and other matters of record applicable to the property, and the real estate taxes from the date of the sale.

TERMS OF SALE: All Cash.

A deposit of 10% of the sales price by bank’s cashier’s check payable to the Trustee may be required of the successful bidder at the time of sale, with the balance due within fifteen (15) days of sale. In the event of default by the purchaser, the deposit shall be forfeited and applied to the costs and expenses of sale and the Trustee’s compensation authorized by the Deed of Trust and the law in such cases.

All costs of conveyance, which shall be by Special Warranty Deed, examination of title, recording fees, notary fees, settlement fees and Grantor’s tax, to be at the cost of the purchaser.

The Trustee reserves the right to reject all bids and withdraw the property from sale, waive the deposit requirements in whole or in part, and extend the period of time in which the purchaser is to make full settlement. Additional terms of sale may be announced at the sale.
